Terms of service

These terms apply when you buy from Gia Morto at giamorto.com. They are based on the Norwegian Consumer Authority's standard terms for online sales of goods to consumers. Nothing here limits the rights you have under Norwegian consumer law.

1. The agreement

The agreement consists of these terms, the information given in the checkout, and anything we have specifically agreed with you. If anything conflicts, what we have specifically agreed takes priority, as long as it does not go against mandatory law. The Consumer Purchases Act, the Cancellation Act, the E-commerce Act and the Marketing Control Act also apply.

2. The parties

Seller: Gia Morto, Løkkeveien 7A, 0253 Oslo, Norway. Email: joachimwhoff@gmail.com. Gia Morto is not VAT registered.

Buyer: the consumer who places the order.

3. Price

The price shown is the total you pay, including any taxes and fees. Shipping is shown before you confirm the order. We cannot charge you anything that was not stated before you bought.

4. When the agreement is binding

The agreement is binding for both parties once you have sent your order. Neither party is bound by obvious typos or pricing errors the other party knew or should have known about.

5. Payment

We accept card payments, Apple Pay and Google Pay. The amount is reserved when you order and charged when your order is shipped.

6. Delivery

Delivery has taken place when you, or someone on your behalf, have received the item. We ship with Posten within Norway. Expected delivery is 2-5 working days after dispatch. If we have not stated a delivery time, we will deliver within a reasonable time and no later than 30 days after your order.

7. Risk

The risk for the item passes to you when you have received it.

8. Right of withdrawal

You have 14 days to change your mind, counted from the day you receive the item. You must notify us within this deadline, for example by email to joachimwhoff@gmail.com or by using the standard withdrawal form. You pay for return shipping unless we have agreed otherwise. You can try the item on as you would in a shop, but if it has been used or washed beyond that, we may reduce the refund to cover the loss in value. We refund the purchase price, including the original standard shipping cost, without undue delay and no later than 14 days after we received your notice. We may hold the refund until we have received the item or you have shown proof that it has been sent. See our refund policy for how to return.

9. Delay

If delivery is late and this is not your fault, you can withhold payment, demand delivery, cancel the purchase and/or claim compensation, as set out in the Consumer Purchases Act. Claims should be made in writing, for example by email.

10. Defects and complaints

If the item has a defect, you must tell us within a reasonable time after you discovered it or should have discovered it. Notice within two months is always considered timely. The deadline is two years from when you received the item. If the item is defective and this is not your fault, you can withhold payment, ask for repair or replacement, ask for a price reduction, cancel the purchase and/or claim compensation, as set out in the Consumer Purchases Act. Normal wear and tear is not a defect.

11. Our rights if you breach the agreement

If you do not pay or otherwise breach the agreement, and this is not our fault, we can withhold the item, demand payment, cancel the agreement and/or claim compensation, as set out in the Consumer Purchases Act.

12. Guarantees

Any guarantee from us comes in addition to your rights under the law and does not limit them.

13. Personal data

Gia Morto is responsible for the personal data we collect. We only collect what we need to complete your order, unless you agree to something else. See our privacy policy for details.

14. Disputes

If something goes wrong, contact us first and we will try to sort it out. If we cannot agree, you can contact Forbrukerrådet (the Norwegian Consumer Council) for mediation.
